
The jury trial is scheduled for Nov. 6 in the Motorola 2005 firing of chief procurement officer Theresa Metty, and U.S. District Judge David Coar found "circumstantial evidence that there was a concerted effort to 'cover one's tracks'" by Chief Executive Edward Zander and other top executives.
If there is no settlement reached, Coar's ruling means that Zander will be called to testify about the reorganization, firing of Metty, and replacement by allegedly less qualified men. Coar wrote that Zander and those below him attempted to construct a record or paper trail to make up for failing to quantify measures pointing to Metty's performance failings.
