
Time Warner Inc. (TWX) owned AOL has had a verdict brought to the Court of Appeals of Virginia upheld in what is believed to be the first conviction in the nation under a state anti-spamming law making it a felony to send unsolicited mass e-mails, according to this WashingtonPost.com article.
Jeremy Jaynes was convicted two years ago of sending tens of thousands of e-mails to America Online customers. He was sentenced last year to nine years in prison on three counts of violating the state's anti-spam law. He plans to appeal this decision.
Jayne, who remained free on $1 million bond while his case was appealed will have his bond revoked and he should begin serving his sentence, according to a statement made by the office of Virginia Attorney General Robert F. McDonnell.
